Official Chefs Under Fire 2011 Rules

Competition Locations & Dates:
Chefs Under Fire 2011 (“CUF”) is a culinary competition, consisting of three Texas Regional Competitions and one Final Competition. The dates of the competitions are as follows (subject to change):

The Entry Period begins Thursday June 23, 2011 at 12:00 AM CST and ends Sunday July 24, 2011 at 11:59 PM CST.

Eligibility:
CUF Entrants must be 18 years of age or older. Employees of Keeper Collection, LLC (”Keeper”) and its affiliates, subsidiaries, divisions, advertising and promotion agencies are not eligible to enter or win a prize. Entrants must qualify as Professional. Professional is defined as a person who is paid or has been paid to cook or bake, or is currently enrolled as a culinary student or has obtained a culinary degree. Entries that are not submitted by a Professional will be disqualified. All Professional entries must be submitted in partnership with a Sponsoring Party. A Sponsoring Party may be a culinary school, restaurant, bar, caterer, or other food vending establishment. Regional finalists must be available to compete in the specified Regional Competition and Final Competition areas on the specified Regional Competition and Final Competition dates (see “Competition Locations & Dates”).

How to Enter:
Step 1: During the period beginning June 23, 2011 and ending July 24, 2011 (the Entry Period), each entrant will visit the Chefs Under Fire website to submit the preliminary Regional Entry form and $25 non-refundable entry fee. An entrant may submit an entry form for all three regions, limited to 1 entry per region. If entering in more than one region, entrant will be required to pay the entry fee for each region and submit a video separately for each region (see Step 3). Entrants will be limited to only one spot in the Final Competition. (An entrant can only be selected to win a maximum of one Regional Competition. If an entrant is selected to compete in multiple Regional Competitions, once he or she wins a Regional Competition, the entrant’s invitation to compete in subsequent Regional Competitions will be revoked. Multiple entry fees will not be refunded.)

Step 2: Submit a biography and headshot to annie@keepercollection.com as soon as possible. Biography and headshot should be attached to the email, not embedded in the email body. Subject line should read: “[Entrant Name] Entry Content“

Step 3: The Entrant has until July 24, 2011 11:59 PM (Entry Deadline) to submit his or her Entry Content. Entry Content must be submitted in the form of a video no longer than 4 minutes explaining why he/she became (or is becoming) a chef. What drives his/her passion for food and why does he/she deserve to compete in Chefs Under Fire? Video must be uploaded to YouTube™ by the Entry Deadline. The title of the video must be Chefs Under Fire 2011 Entry Video-{Entry Name}-{Region}. Video must be tagged with “Chefs Under Fire 2011”. Once a Video entry has been submitted, it may not be edited or resubmitted with revisions for the same Region. Entrant acknowledges and agrees that YouTube, LLC is not a Sponsor of CUF and has no responsibility or liability regarding the conduct or administration of CUF.

All Entry Videos received during the Entry Period will first be previewed and screened by Keeper, whose decisions will be final and binding in all matters relating to CUF. Keeper will narrow the entries to top qualifying entries for a Public Vote. The Public Vote will narrow the entries to 8 Regional Semi-Finalists for each Region.

Entry Content Guidelines:

All entries must meet all of the following requirements:

  • Language: English.
  • Creative Requirements: Entries must address the outlined topic. Entries will be judged on creativity, knowledge, and passion.
  • Compliance: Entries must not:
    • depict dangerous or reckless conduct, including risky or unsafe techniques or activities;
    • include trademarks, logos, or copyrighted material not owned by entrant or used without permission (such as brand names, company names, music, photographs, works of art, or images published on or in Web sites, television, movies, or other media) – Keeper reserves the right to edit or blur references to third party brands, logos or works;
    • use individuals’ names, in whole or in part (including the entrant’s last name) without permission;
    • refer to public figures;
    • contain profanity, pornographic, or sexual content, content promoting illegal drugs, tobacco, firearms, or weapons, hateful content of any kind (including racism, sexism, etc.), content that promotes violence or harm to another living creature, or any other offensive, obscene, or inappropriate content;
    • defame, misrepresent, or contain disparaging remarks about other people or companies, including, but not limited to Keeper and other CUF Sponsors;
    • promote a political agenda regardless of the political affiliation;
    • primarily act as an advertisement or product placement for any particular product or service;
    • contain materials embodying the names, likenesses, photographs, or other identifying elements of any person, living, or dead without permission.
  • Running time: 4 minutes maximum, including any credits. If entry is longer than 4 minutes, only the first 4 minutes will be judged.
  • Compliance: Video Submissions and recipes must comply with the YouTube Site’s Terms of Use (http://www.youtube.com/t/terms) (the “Terms of Use”).
  • By entering in CUF, each Entrant represents and warrants that (i) he or she has obtained all the rights, licenses, and permissions in writing from each person (including parent/legal guardian) who appeared in or helped to create the entry; and (ii) the entry does not infringe or violate the rights of any third party, including but not limited to, copyrights, trademarks, patents, trade secrets, logos, contract and licensing rights, rights of publicity or privacy, moral rights, or any other intellectual property rights. By entering in CUF, each Entrant grants Keeper, other CUF Sponsors and their affiliates the right to edit and publish the entry in publications, products and online services, regardless of whether the entry is chosen to advance to further rounds or receives a prize. Entries that are deemed by Keeper, in its sole discretion, to be in violation of these Official Rules, the YouTube Terms of Use (video entries only), the YouTube Community Guidelines (video entries only) or to be otherwise infringing, defamatory, or generally not in keeping with the image of Keeper, will be void and deleted.

Public Voting to Determine Regional Semi-Finalists:
The Voting Period will begin at 9:00 AM August 1, 2011 and will close at 11:59 PM August 5, 2011. Eligible persons must have a valid email address and may vote for Entries that are posted to www.ChefsUnderFire.com during the Voting Period. Each day during the Voting Period, eligible persons may vote a maximum of once per day per email address. At the conclusion of the Voting Period the votes will be tabulated. The top eight (8) voted entries for each Region will be announced on August 8, 2011 via email to selected entrants, and posted to www.ChefsUnderFire.com, Facebook, Twitter, and other available media outlets.  Two alternates will also be determined and notified via email in the event that a Regional Semi-Finalist is unable to compete on the day of the event. The use of automated or other means to submit a rating or circumvent any of the limitations described above is prohibited and all such votes will be void. Ratings sent via script, macro or automated means or with the intent to impair the integrity of the voting process are void. Entrants are prohibited from obtaining ratings by any fraudulent or inappropriate means, including, without limitation, offering prizes or other inducements to members of the public, as determined by Keeper in its sole discretion and all such ratings will be void.

Regional Competition & Judging Details:
All eight Regional Semi-Finalists will compete in a preliminary onsite mini challenge.  This challenge will be judged by the Regional Judges Panel and only the top four contestants will immediately continue in the Regional Competition as Regional Finalists. The four Regional Finalists will be asked to prepare 4 identical plated dishes onsite under a time restriction to be determined prior to the competition. All ingredients will be provided and announced at the time of competition. Contestants are required to bring their own knives to be used during the competition. All other cooking and plating utensils and equipment will be provided unless otherwise specified by Keeper. Dishes will be judged on taste (50%), presentation (25%), and originality (25%). Judging is final. One contestant will be selected as a Finalist to move on to the CUF Final Competition on October 16, 2011 at the AT&T Executive Education & Conference Center in Austin, TX. Alternates will be selected in the event that any selected Finalist is unable to compete on the day of the CUF Final Competition. All decisions are final. Each Regional Winner will agree to one non-paid appearance arranged by Keeper Collection.

Final Competition & Judging Details:
The CUF Final Competition will require contestants to execute a pre-developed 4 serving dish (entrée and side dish) to be judged by a Celebrity Chef Judging Panel. The dish must use all specified secret ingredients which will be announced no later than 12 days prior to the competition date (October 16, 2011). Contestants will be required to submit a recipe for the competition dish using the specified ingredients and must indicate the cost of each ingredient used (excluding staples, such as spices). Contestants will be required to create a banquet version of the same recipe that will not exceed a dollar amount to be determined no later than 12 days prior to the competition date. The Banquet Version recipe will be recreated by a culinary team on the day of the event for up to a 300 person audience to sample.  Recipes must include a list of required kitchen utensils and equipment. Recipes should be submitted via email to annie@keepercollection.com by Friday October 7, 2011, 11:59 PM. Competitors are required to bring their own knives to the competition. After reviewing the recipes, finalists will be notified if they need to bring any other utensils or equipment not available at the venue. Contestants are required to execute the recipes on-site in the exact manner in which it was submitted and approved. Dishes will be judged on taste (50%), presentation (25%), and originality (25%). Judging is final. One overall winner will be selected by the Judges Panel and one Fan Favorite winner will be selected via text. The winner in each category can be the same competitor. Winners will be announced at the event. Judging sheets will not be shared with competitors. The Final Competition Winner(s) will agree to one non-paid appearance arranged by Keeper Collection.

Privacy Policy:
Any entry information collected from the Competition shall be used only in a manner consistent with the uses indicated to entrants at the time of entry, with these Official Rules, and the Privacy Policies of YouTube.

Keeper’s Use of Submissions:
By entering this Competition, and to the extent allowed by law, entrants grants Keeper, Sponsors, YouTube LLC, and each of their affiliates, licensees, promotional partners, and third party marketing entities, the absolute right and permission to edit, modify, cut, rearrange, add to, delete from, copy, reproduce, translate, dub, adapt, publish, exploit, and use the content of and elements embodied in the Submissions, recipes, and the entries themselves, in perpetuity in any and all media, including but not limited to digital and electronic media, computer, audio and audiovisual media (whether now existing or hereafter devised), in any language, throughout the world, and in any manner, for trade, advertising, promotional, commercial or any other purposes without further review, notice, approval, consideration, or compensation. Entrants waive and release Keeper, Sponsors, YouTube LLC, and each of their affiliates from any and all claims that entrants may now or hereafter have in any jurisdiction based on any claims, including but not limited to “moral rights” or “droit moral” or unfair competition with respect to Keeper’s, Sponsors’ or YouTube’s exploitation of Submissions, recipes, or entries without further notification or compensation to entrants of any kind, and agree not to instigate, support, maintain, or authorize any action, claim, or lawsuit against Keeper, Sponsor, YouTube, and each of their affiliates, licensees, or any other person in connection with this Competition, on the grounds that any use of any entry, or any derivative works, infringe or violate any of entrants rights therein.

By entering this Competition, entrants agree that Keeper, Sponsors, YouTube LLC, and each of their affiliates, licensees, promotional partners, and third party marketing entities shall have the right and permission to use the name, picture, voice, biographical data, photograph, testimonial, or other likeness and/or prize information or personal exposition (and/or any edited portion thereof), and/or any information contained in his/her Submission, recipe or entry for promotional, advertising, and/or publicity purposes in any media, now or hereafter known, throughout the world in perpetuity, without compensation or notice to, or further consent of, to the winner to the extent permitted by law.

Limits of Liability:
By entering, entrants agree to release, defend and hold harmless Keeper, Sponsors, and YouTube LLC and their respective parents, subsidiaries, affiliates and each of their respective officers, directors, shareholders, agents and employees, nor any Internet access providers (collectively “Released Parties”), from and against any and all claims, actions and/or liability (including reasonable attorneys’ fees and expenses) for any violation of the Official Rules by entrants (including any warranties made by participants), any claims of infringement or violation of a third party’s rights by a Submission or recipe, and any injuries or death, loss or damage of any kind (including incidental or consequential damages and lost profits) arising from or in connection with participation in and/or entry into the Competition (including preparation accidents occurring in connection with potential entries in the Competition), any acceptance or use of any prize (including any losses or liability associated with travel or accommodations) and the conduct of any demonstration. The Released Parties are not responsible or liable for, and assume no responsibility for (i) any unsafe, dangerous or reckless conduct, including cooking techniques or activities involving fire or flames, (ii) any personal injury or property damage arising from preparation accidents, (iii) any error, omission, interruption, defect or delay in operation or transmission at any Web site, (iv) failure of any entry to be received by YouTube due to technical problems, human error or traffic congestion on the Internet or at any Web site, (v) communications line, hardware and/or software failures, (vi) damage to any computer (software or hardware) resulting from participation in the Competition, (vii) theft or destruction of, tampering with, unauthorized access to, or alteration of entries and/or entry information, or (viii) entries which are late, lost, stolen, damaged, illegible, unintelligible and/or postage due (or any combination thereof). Any entrant who attempts to tamper with this Contest in any way shall be disqualified. ANY ATTEMPT TO DELIBERATELY UNDERMINE THE CONTEST SITE OR THE LEGITIMATE OPERATION OF THE CONTEST MAY BE IN VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES AND OTHER REMEDIES (INCLUDING ATTORNEYS’ FEES) FROM ANY SUCH INDIVIDUAL TO THE FULLEST EXTENT OF THE LAW, INCLUDING CRIMINAL PROSECUTION.

General:
All federal, state and local laws and regulations apply. Competition void where prohibited or restricted by law. If, for any reason, the Competition is not capable of running as planned by reason of infection by computer virus, worms, bugs, tampering, hacking, unauthorized intervention, fraud, technical failures or any other causes which, in sole opinion of Keeper, corrupt or affect the administration, security, fairness, integrity or proper conduct of this Competition, Keeper reserves the right, at its sole discretion, to cancel, terminate, modify or suspend Competition, and determine the Winner from entries received prior to action taken, or as otherwise deemed fair and equitable by Keeper. No refunds of any entry fees or any other costs associated with entry will be refunded under any circumstances. Except where prohibited, each entrant agrees that any and all disputes, claims and causes of action arising out of or connected with this Competition or any prize awarded shall be resolved under the laws of the State of Texas, without respect to any conflict of law issues, and each participant agrees that such shall be resolved exclusively by the Federal and State Courts of Travis County, Texas. In the event any of these terms become or are declared to be illegal or otherwise unenforceable by any court of competent jurisdiction, such term(s) shall be null and void and shall be deemed deleted herefrom. All remaining terms shall remain in full force and effect.
